The Provincial Court of Baleares has acquitted a man who was accused of repeatedly raping his own six-year-old daughter in Mallorca between 2020 and 2023. The ruling, which spans over 50 pages, concludes that the child's testimony does not meet the legal requirements to undermine the presumption of innocence of the accused.
The court bases its decision on the multiple contradictions and variations detected in the child's account. According to the ruling, the version contains significant inconsistencies regarding fundamental aspects of the accusation, such as the specific locations or the manner in which the events allegedly occurred.
The ruling also questions the testimony of the child's mother, the former partner of the accused. The woman attempted to link a condition in the child's intimate areas with the alleged assaults, but the process established, through a WhatsApp conversation, that the real origin of the condition corresponded to a focus detected at the child's school.
Another key point evaluated by the judges focuses on the medical evidence related to a sexually transmitted disease that the child suffered from. While the child tested positive for this infection, both the father and his current partner tested negative in the corresponding analyses.
During the oral hearing, the accused, represented by lawyer David Barón, categorically denied all the allegations. The prosecution sought a sentence of 12 years in prison.
Given the lack of solidity and inconsistencies in the evidence presented by the prosecution, the court has decreed the acquittal of the accused. The ruling is not final and can be appealed to the Supreme Court.
