A Cala Llamp resident halts the expansion of a property encroaching on his land

The General Directorate of Legal Security dismisses Mallorca Talismán's appeal and confirms the suspension of 157 square meters in Cala Llamp.

The General Directorate of Legal Security dismisses Mallorca Talismán's appeal and confirms the suspension of the registration of 157 additional square meters in Cala Llamp, following opposition from a neighbouring property owner.

A property company aimed to expand the registered area of its estate in the exclusive Cala Llamp urbanisation in Andratx. The operation involved increasing the area from 1,250 to 1,407 square meters, an increase of 157 square meters which, in an area where the square meter costs 15,000 euros, has a value close to 2.4 million euros. However, the plan faced opposition from a neighbouring resident, who claimed that the new measurement encroached on his land.

Documented opposition from the neighbour

The Property Registry of Palma number 10 suspended the registration requested by Mallorca Talismán upon finding that the increase in area exceeded 10% of the original surface and that there was documented opposition from the affected neighbour. The latter provided a technical plan used in a building permit to demonstrate that the boundaries proposed by the property company encroached on his land.

The company appealed the decision to the General Directorate of Legal Security and Public Faith, which in a resolution published in the BOE on July 8 dismissed the appeal and confirmed the registrar's refusal. The agency emphasises that the registration procedure is not the appropriate channel to resolve boundary disputes between private parties.

The judicial route still open

The resolution does not determine who is right regarding the disputed strip of land, but rather confirms the existence of a real controversy. The General Directorate reminds that such disputes should be resolved through agreement between the parties, registration conciliation, or, as a last resort, in the courts. Mallorca Talismán can still appeal the decision within two months of its notification.

For residents of Cala Llamp, the case serves as a warning of how urban pressure and high land values generate neighbourhood conflicts. The urbanisation, one of the most sought-after in Mallorca, features villas and residential buildings that line the coastline, with hardly any free spaces.

A recurring conflict on the island

The dispute in Cala Llamp is not an isolated case. In 2023, the Calvià Town Hall rejected an appeal from two landowners in Galilea who lost thousands of square meters following the redefinition of municipal boundaries, in favour of the public estate of Galatzó. The 'balearisation' of the coastline, with its unstoppable tourist growth, leaves episodes of struggle for every inch of land.

The neighbour who opposed the expansion managed to halt the property company's attempt, but the battle over the boundaries of his parcel could continue if Mallorca Talismán decides to pursue the judicial route. In the meantime, the resolution from the General Directorate sets a precedent on how registrars should act in the face of boundary conflicts: not to register increases in area when there is founded opposition.
